From Black Friday to the last-minute rush before Christmas, South Florida stores and malls are packed. Shoppers are in a hurry, workers are stretched thin, and parking lots turn into a free-for-all.
That busy mix leads to a lot of injuries every year. Spilled drinks, boxes in the aisles, wet floors near the entrance, and drivers hunting for a spot. Here’s how to protect yourself, and what to do if you get hurt.
Common holiday shopping injuries
- Slip-and-falls on spills, wet floors, or rain tracked in from outside
- Trip-and-falls over boxes, loose mats, cords, or holiday displays
- Falling merchandise from high shelves that were stocked in a rush
- Crowd injuries during doorbuster sales
- Parking lot crashes between cars, and cars hitting people on foot
- Poor lighting in garages and lots after dark
How to stay safe while you shop
- Shop early or online. Weekday mornings are calmer than weekends.
- Wear shoes with grip. Flip-flops are a Florida favorite, but they slip easily on wet tile.
- Watch where you walk. It’s easy to look at sale signs and miss a spill on the floor.
- Park in a well-lit spot and walk in marked lanes when you can.
- Drive slowly in lots. Expect people and kids to walk out from between cars.
- Keep your hands free. Use a cart instead of stacking bags you can’t see over.
Who is responsible when you get hurt?
In Florida, stores and property owners must keep their space reasonably safe for customers. That means cleaning spills, fixing hazards, and warning people about dangers.
If you slip on something in a store, Florida law usually requires you to show the business knew about the danger, or should have known. For example, a spill that sat there for a long time, or a leak that happens again and again. This is why proof matters so much in these cases.
Florida also uses a fault system. If you’re found more than 50% at fault for your own injury, you can’t recover money. If you’re less at fault, your payment may be reduced by your share. Insurance companies often try to push more blame onto you. A lawyer can help push back.
What to do right after a fall
- Report it to a manager and ask for a copy of the incident report.
- Take photos of exactly what caused your fall before it gets cleaned up. Include your shoes and the area around it.
- Get witness names and phone numbers.
- Ask about cameras. Stores often record over their video quickly. A lawyer can send a letter asking them to save it.
- See a doctor. Back, hip, knee, and head injuries can get worse over the next few days.
- Don’t sign anything or give a recorded statement to the store’s insurance company without advice.
